Terms of Service — 100 Million Beers / The World Race

In plain words: 100 Million Beers is a free game where the world counts beers together. You must be 18 or older AND of legal drinking age where you live. Your beer photos are shown only to your own Team — never publicly — and are deleted after the season. Don't photograph people, don't fake beers, don't be under age. We can remove fake counts and ban cheaters. We never encourage you to drink: there's a daily cap, no streaks, and no individual leaderboards. Disputes are resolved by individual arbitration in Florida unless you opt out within 30 days (Europeans keep their local courts and rights).

These Terms of Service ("Terms") are a contract between you and CAMMY LLC, a Florida limited liability company doing business as The World Race ("The World Race," "we," "us"), 1738 SW 57th Ave, Unit # A505, Miami, FL 33155, USA. Contact: support@theworldrace.app.

They govern the 100 Million Beers mobile application (the "App"), the websites theworldrace.app and worldrace.app (the "Site"), and any related services (together, the "Service"). By using the Service — including as a guest without an account — you agree to these Terms, our Privacy Policy, Community Guidelines, and Age & Responsible Drinking Policy, which are part of these Terms.

1. Who may use the Service

You may use the Service only if all of the following are true:

There is no under-age or "spectator" tier: every user must meet the age requirement. When you first use the Service you must truthfully confirm your age; lying about your age is a violation of these Terms.

2. The Service: what it is (and isn't)

The Service hosts collective counting events ("Seasons"). During a Season, participants photograph a beer they are lawfully consuming; verified photos each add one to a global count and receive a permanent sequence number. When a Season ends — on its announced end date or when its target is reached — the count freezes and results are archived.

3. Guests, accounts, and carry codes

You can participate without creating an account; a guest identity is tied to your device or browser. You may later "claim" your contributions by signing in (Sign in with Apple, and other providers we may add). Claiming permanently attaches your guest history to your account.

"Carry codes" (which move website contributions into the App) are single-use, expire after a short window, and belong to whoever redeems them first — treat yours like a ticket. We are not responsible for contributions lost because a guest identity was cleared (for example, by clearing your browser data) before being claimed.

You are responsible for activity that happens through your device or account.

4. Your content and the license you give us

"Your Content" means the photos you submit and anything else you post.

Rules for photos. Photograph the beer, not people. You agree that Your Content will not include: identifiable people without their consent; anyone under legal drinking age, ever; anything other than what the Community Guidelines allow. You must own or have the right to everything you submit.

License. You keep ownership of Your Content. You grant CAMMY LLC a non-exclusive, worldwide, royalty-free, transferable, sublicensable (to our service providers) license to host, store, reproduce, technically modify (e.g., resize), and display Your Content in order to:

  1. operate the Service — including showing your photos to your Team, verifying counts (including automated/AI review), moderation, and computing aggregate statistics;
  2. promote the Service — including in press materials, marketing, app-store listings, and on the Site — provided that we will not use a photo showing an identifiable person for promotion without that person's consent.

The license to a photo ends when the photo is deleted (photos are automatically deleted after each Season per the Privacy Policy), except that (a) aggregate statistics derived from it survive, and (b) promotional materials lawfully created while the license was active may continue to be used.

5. Counting rules, fraud, and moderation

To keep the world's count honest, we enforce (and may change) anti-fraud measures, including: a per-person daily cap on counted beers; minimum time between counts; duplicate-image detection; automated AI review of every photo; and a strike system escalating from provisional counting to suspension to permanent ban.

Automated access, scripting, bulk submission, scraping, or interfering with the Service is prohibited.

6. Alcohol: your choices are yours

The Service counts beers; it does not tell you to drink them, and it is built to never push consumption: a daily cap with a hard stop, no streaks, no individual leaderboards, and no rewards that scale with personal volume.

You are solely responsible for your decisions about alcohol, including whether to drink at all, how much, and everything that follows — and you must always comply with local law. To the maximum extent permitted by law, you assume all risks associated with your alcohol consumption, and we are not liable for injury, illness, or damage arising from it.

7. Intellectual property

The Service, including its design, text, software, and the marks "The World Race" and "100 Million Beers," belongs to CAMMY LLC or its licensors. We grant you a personal, non-transferable, revocable license to use the App and Site as intended. No other rights are granted. Copyright complaints are handled per our Copyright/DMCA Policy.

8. The App and Apple

The App binary is licensed to you under Apple's standard Licensed Application End User License Agreement; these Terms govern the Service itself. Apple is not responsible for the Service or its content and has no obligation to provide support or maintenance for it.

9. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Service will be uninterrupted, error-free, or that any count, number, ranking, or archive will be preserved. Seasons are events; the Service may end.

10. Limitation of liability

To the maximum extent permitted by law: (a) neither CAMMY LLC nor its members, officers, or suppliers will be liable for indirect, incidental, special, consequential, or punitive damages, or lost data or goodwill; and (b) our total liability for all claims relating to the Service will not exceed US $100 (the Service is free). These limits do not apply where they cannot lawfully be excluded — including liability for fraud, gross negligence, willful misconduct, or, for users in the EU/UK, any liability that consumer law does not allow us to limit.

11. Indemnification

You will indemnify CAMMY LLC against third-party claims arising from Your Content or your violation of these Terms or of law, to the extent permitted by the consumer-protection law of your residence.

12. Disputes: arbitration, class waiver, opt-out (US users)

Please read this section carefully — it affects your rights.

If you live in the EEA, UK, or Switzerland: this Section 12 does not apply to you. You may bring disputes in the courts of your country of residence, and you keep all rights that your local consumer law gives you and does not allow you to waive.

13. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules — except that if you reside in the EEA, UK, or Switzerland, you also benefit from any mandatory protections of your local law.

Notice to California users: Complaints may be directed to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or (800) 952-5210 (Cal. Civ. Code §1789.3).
